RCI is not subject to judicial review

The Kuala Lumpur High Court has ruled that the Royal Commission of Inquiry onto Malaysia’s withdrawal over its appeal in the International Court of Justice decision in 2018 that gave away Pulau Batu Puteh to Singapore will remain off-limits to the public.

“The subject matter is not amenable to judicial review,” ruled High Court judge Datuk Amarjeet Serjit Singh on former premier Tun Dr Mahathir Mohamad’s legal bid to have the proceedings to be conducted in the open.

The court also ruled against Dr Mahathir’s bid to recuse three members of the RCI including its chairman, Tan Sri Md Raus Sharif.

The decision was delivered this morning.

Singh however granted Dr Mahathir’s application to attend the hearing himself and with his lawyers.
