Motion to stay charges filed for environment activist
A motion has been filed to permanently stay the charges of unlawful occupation of state land by environment activist and former Khazanah Alam Malaysia (PEKA) president Puan Sri Shariffa Sabrina Syed Akil.
The three charges has to be stayed permanently since it is mala fide in nature and is an abuse of the court process. Alternately, the cases must be cancelled out, the motion stated.
The motion that was filed also called for Shariffa to be discharged and freed from all of her criminal charges.
In addition to that, the motion filed urged the court to provide reasonable relieves to the Shariffa.
Former Khazanah Alam Malaysia (PEKA) president Puan Sri Shariffa Sabrina Syed Akil is facing three charges of unlawful occupation of state land two years ago.
She is alleged to have committed the offence on June 10 and 11, 2021 in Bentong, Ulu Dong and Tras in Pahang.
The land in question was turned into resort area by Tanah Aina Fareena Cafe and Restaurant, Tanah Aina Fahad Glamping Resort and Tanah Aina Farrah Soraya Exclusive Eco Resort.
The motion was filed on several grounds.
In the event the charges are not cancelled or delayed would cause miscarriage of justice to Shariffa.
All the criminal charges and against Shariffa contravenes Article 5 of the Federal Constitution. A delay in filing the charges would prejudice the applicant’s rights.
The charges are faulty as it failed to abide section 425(1)(a) of the National Land Code since the respondent – the government – was aware of the Tanah Aina Sdn Bhd’s position on the concerned land.
