DAP senator sues Urimai head for defamation
Senator Dr A Lingeshwaran of the DAP has filed a defamation suit against Urimai head P Ramasamy over a Malaysiakini article dated May 2 in which the latter described the former as one without common sense and unworthy to be in the medical profession.
Ramasamy had made the accusation over Lingeshwaran’s call for UiTM to be opened up to allow non-Bumiputera to be enrolled for post graduate courses related to cardiothoracic surgery.
“The article implied that the Lingeshwaran was unfit to be a Senator, wasn’t qualified to be in the medical profession and untrustworthy as senator or a medical doctor. It also implied that he was a dishonest person.
“The publishing of defaming terms as above has caused injury to his character and reputation.”
This was stated in the demand statement dated Aug 21 that was filed by Lingeshwaran’s lawyers from Gunaseelan & Associates at the Butterworth Sessions Court.
The notice of demand to Ramasamy for a withdrawal of defamation terms and apology was sent on July 10.
Ramasamy however denied any liability via letters served on July 25 and 30.
As such Lingeshwaran is requesting the court for general and exemplary damages. No amount was mentioned.
He also requesting an injunction to prevent Ramasamy or his representative from repeating the defamatory terms.
In addition to that, he has requested for an interest 5 percent for the damages that is to be determined by the court since July 10, cost of action and other reliefs.
A case management via e-review was held on Sept 23.
