How can PHEB provide assistance to non-Hindus?
Hindus in Penang are questioning defence lawyer Shamser Singh Thind’s claim that the PHEB is empowered to give out funds and assistance to Muslims.
“The PHEB is governed by the Hindu Endowments Ordinance (Cap. 273) and is established specifically to manage Hindu religious endowments and assets in Penang,” said a source who wished to remain anonymous.
“Its primary mandate is to serve the Hindu community, including managing temples, education funds, and welfare assistance for Hindus.
“So to answer your first question: Can PHEB give welfare assistance to Muslims?
“Legally and by its founding ordinance, PHEB is not meant to provide welfare assistance to non-Hindus.
“This would be similar to Majlis Agama Islam Pulau Pinang (MAIPP), which provides welfare and financial assistance exclusively to Muslims, as per its Islamic jurisdiction and purpose.
“If PHEB funds are being disbursed to non-Hindus (e.g. to Muslims), it raises questions of legality, misuse of trust funds, and deviation from the Board’s core mandate.
“This is especially sensitive when compared to strict religious endowment protocols in other religious bodies.
The lawyer had made the claim after representing his client, ex-PHEB chairman P Ramasamy who was slapped with 17 charges of criminal breach of trust involving funds meant for the golden chariot for Thaipusam in Penang and welfare assistance.
Shamser claimed that Ramasamy extended financial assistance to Indian Muslims.
